Probate laws are state specific.  The path that estates takes through probate may vary depending on a number of factors. More information on applicable procedures will follow.

Answering the following questions will help determine whether an estate will go through:

1. What is the decendent's primary state of residence? This is indicated by their most recent federal or state tax return.

2. Is there a Will?

3. Is real estate part of the estate?
